This PRIVACY POLICY applies to all the users of our website “TOPALL” and to any Services where this PRIVACY NOTICE is referenced. By using our Services and/or registering for an account, you are accepting the terms of this PRIVACY NOTICE and our TERMS & CONDITIONS. It is advised that the PRIVACY POLICY is read with the TERMS & CONDITIONS, PRIVACY NOTICES or POLICIES that may be provided from time to time when your Personal Information is collected and used.
The purpose of this Privacy Policy is to lay out how, why and when “TOPALL” uses your Personal Information so as to comply with the Privacy Laws of the country for the time being in force. The Privacy notice describes:

“TOPALL” respects and protects your privacy (personal information) and strictly uses it only in a manner that is lawful, reasonable and solely for the purpose of collection, which is to improve our services. We seek to provide the best service to our users and to make it matchless; we need to use some of your personal information.
IN THIS PRIVACY POLICY, THE TERMS:
  1. a. “YOU” or “ANY PERSON” or “USER” or “YOUR” means , any user, any visitor, any client, any person, individual, firm, company, association, syndicate, partnership, joint venture, trustee, trust, corporation, division of a corporation, unincorporated organization or other entity or a government agency or political subdivision thereof who visits, or uses this Mobile App for any purpose or service;
  2. b. “REGISTERED USER(S)” refers to any person who is registered under our Mobile App and has provided us with a unique email address, password and other personal information in order to avail our services.
  3. c. “WE”, “US” or “OUR” refers to “TOPALL”, a Mobile App developed and operated byVVT Solutions Pvt Ltd a registered company under the Companies Act, 2013.

CLAUSE 1 - WHAT PERSONAL INFORMATION WE COLLECT AND PROCESS
We collect information you provide us when you register for an account, verification of your account, when you use our services, engage with our community, interact with your account and when you contact us.

CLAUSE 2 - USER TRACKING AND COOKIES
We use cookies and other technical information to personalize your visit to our Mobile App, to track user trends, patterns and selections for authorized download and for technical reasons connected with your use of our Mobile App.
When you visit our Mobile App, our Mobile App server automatically records the name of your ISP (Internet Service Provider), the website from which you visit us, the pages you visit on our Mobile App in the same sequence, date and length of visit.
By using our Mobile App, you consent to the privacy policy and Terms & Conditions hereby set out.
CLAUSE 3 - USE OF PERSONAL INFORMATION
We process and use the personal information collected only for the purpose of use as emphasized below including improving our services, identification/verification, marketing and advertising and legal compliance. We may process and use your personal information to:

We assure you that we will not use your Personal Information for any other purpose without your permission. It is also to be noted that by using our Mobile App and availing our services, you assent to our privacy policy, Terms & Conditions, other policies and provide us your consent to use your personal information for the abovementioned uses.
CLAUSE 4 - RETENTION OF PERSONAL INFORMATION
As long as your account or your services are active, we shall retain your personal information as it is deemed necessary for our operation. We may also keep personal information from closed accounts to comply with national laws, prevent fraud, collect fees owed, assist with any investigation, enforce our Terms & Conditions and take other actions as per existing laws. In case your personal information is no longer necessary, we ensure to securely dispose of it after a period of 2 years from when you have discontinued using our Mobile App, “TOPALL” after expiry of the scope for renewal of services. TOPALL shall not be liable for any loss of data after expiry of the 2 years as stipulated above.
CLAUSE 5 - DISCLOSURE OF PERSONAL INFORMATION
We, “TOPALL” at our Mobile App may disclose your personal information with third parties such as suppliers, buyers, service providers, financial institution partners, law enforcement, government officials, fraud detection agencies or other third parties in order to comply with the existing laws and regulations. Furthermore, we reserve the right to disclose such Personal Information to third parties where a complaint arises concerning your use of our Mobile App and where we have conclusive evidence or suspicion to believe, in our sole discretion, that your use of our Mobile App is inconsistent with the Privacy Policy.

  • “TOPALL” employees, staff and other third parties in order to enable us to carry on and offer our services.
  • law enforcement, government officials, fraud detection agencies or other third parties for purposes of prevention of illegal activities, investigation of offences such as fraud, intellectual property infringements, or any illegal activities and activities that may result in us incurring legal liability or financial loss.
  • Our service providers may access your personal information solely in connection with the services they perform for us (marketing, public relations, etc) to facilitate our business operations and such personal information shall be kept confidential.
  • Our suppliers and sellers to interact with directing regarding your availed services, in order to comply with regulatory obligations and any such purpose that requires their involvement
CLAUSE 6 - SECURITY MEASURES TO PROTECT PERSONAL INFORMATION
We, “TOPALL” at our Mobile App ensure that your personal information is protected using advanced technical and administrative security measures. We have reasonable security measures, policies and control mechanisms in place to prevent unauthorized or unlawful access, use, disclosure or destruction of your personal information and loss or damage to your personal information in our possession. We implement the same through:
  • Physical, technical and network security.
  • Access controls and monitoring of access.
  • Secure storage, destruction and encryption of records of Personal Information.
  • Personal Information breach reporting and remediation.
  • Security and confidentiality obligations on third parties.

However, if you suspect that your account has been misused, we urge you to contact our customer services and shall respond swiftly to your queries.

CLAUSE 7 – COMPLIANCE TO DIGITAL PERSONAL DATA PROTECTION ACT, 2023

Kindly read and be aware of this Privacy Policy is in adherence to Digital Personal Data Protection Act, 2023.

CLAUSE 8 - SHARING THE DATA

We, “TOPALL” at our Mobile App do share information obtained from the users of this page at the marketplace, to any third-party sources for limited purposes including but not limited to analytics. It is deemed that all USER(S) are consented expressly by the USER’s usage of services of this Mobile App. Any breach of data from the end of the third parties shall not be attributable to TOPALL. Sharing of data between the subsidiaries or sister concern or desginated partners of TOPALL is deemed to be accepted by the USER.

CLAUSE 9 – CONTROL OVER THIRD-PARTY

We, “TOPALL” at our Mobile App have no control over the activities or management of personal data by any THIRD-PARTIES. We advise you to read the respective PRIVACY POLICIES of the respective THIRD-PARTY SITES before engaging into them.

We duly inform you that this PRIVACY POLICY is limited to only this Mobile App and shall not extend to any THIRD-PARTY SITES.

We do not interfere with the data gathered from the cookies of any THIRD-PARTIES as we have no control over them. We advise you to opt to disable such cookies if you wish to stop them accessing your personal data.

CLAUSE 10 – INDEMNITY

We, “TOPALL” in our Mobile App use Data Loss Prevention Software (DLP Software) to safeguard your personal data from being compromised. It is hereby clarified that despite the installation of DLP Software, if there is any loss to personal data for reasons not directly attributable to “TOPALL”, then “TOPALL” shall not be liable for the same in any manner whatsoever.
